【摘要】:1.1StandardguideforthederivationofquantitativeassessmentsofthecredibilityofproposedwitnesstestimonythroughtheapplicationofestablishedstatisticalprinciplestocombinationsofPDDexaminationresults,andfortheutilizationofsuchassessmentsintheinterestsofjustice(TheMarinProtocol)1.2Thisstandarddescribescircumstancesinwhichprovenstatisticalprinciples,appliedtoPDDresults,canreliablyquantifythetrustworthinessoruntrustworthinessofwitnesstestimony,and1.2.1Delineatesrequirementsnecessarytoeffectthegenerationandpracticaluseofsuchresults,including:1.2.1.1Criteriaregardingwitnessestobeexamined,1.2.1.2Criteriafordeterminingfactsuponwhichwitnessesaretobeexamined,1.2.1.3Certificationofexaminerseligibletoconductexaminations,1.2.1.4Combinationsofresultswhichsupportstronginferences,and1.2.1.5Appropriateusestowhichstronginferencescanbeput.1.3CourtsandothersresponsibleforadjudicatingquestionsoffactmaychoosewhetherandwhentoinvokepairedPDDtesting.1.3.1Thisguideexpressestherightsandobligationsofallparticipantsinordertobestservetheinterestsofjusticewhenitisinvoked.1.3.2PairedPDDtestingmustnotbeinvokedinanycaseinanyjurisdictionwheretodosowouldviolatethelawsofthatjurisdiction.1.3.3Adherencetotheseguidelinesensuresthattheconclusionsreachedwillbevalid.1.4Thisstandardisdirectedtotheproposedtestimonyofwitnessesincriminal,civil,administrativeandfamilycourtlitigation,regardingfactualclaims,where1.4.1Itisunlikelythatthewitnessescouldbehonestlymistaken,and1.4.2Thefactsindisputearesuchthatthecasemayhingeonwhomthetrieroffactbelieves;whenever,1.4.3Witnessesonoppositesidesofacaseoffercontradictorytestimony.1.4.4Twoormorewitnessestestifyingforonesideoffermutuallycorroboratingtestimony.
